1. ELIGIBILITY. The ThriftBooks Tote Bag Giveaway and ReadingRewards Bonus Point Promotion (the “Giveaway and Promotion”) is open to all legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry, except for the following individuals: (a) employees, officers, directors, agents, and representatives of Thrift Books Global LLC (“ThriftBooks”) and its affiliates, subsidiaries, distributors, suppliers, advertising, and giveaway agencies (“Excluded Individuals”); (b) the immediate family members (mother, father, sister, brother, child, husband, wife and their respective spouses, regardless of where they reside) of Excluded Individuals; and (c) persons living in the same household as Excluded Individuals—whether or not they are related. The Giveaway and Promotion is void where prohibited by law; all applicable federal, state, and local laws apply. If a winner is at least 18 years old, but still considered a minor in his or her jurisdiction of residence, ThriftBooks reserves the right to award the Prize (as defined below) to the winner’s parent or legal guardian, who will be required to fulfill all requirements set forth in these Official Rules.
2. GIVEAWAY AND PROMOTION PERIOD. The Giveaway and Promotion entry period begins at 12:01 AM Pacific Daylight Time on April 22, 2024, and ends at 11:59 PM Pacific Daylight Time on April 26, 2024 (the “Giveaway and Promotion Period”). ThriftBooks maintains the official timekeeping device.
3. ENTRY. You may enter the Giveaway and Promotion by purchasing at least four (4) used books (the “qualifying purchase”) from ThriftBooks during the Giveaway and Promotion Period while logged in to your ThriftBookd account. You may also enter the giveaway using the alternative method of entry described in Section 3.1. All customers logged into their ThriftBooks account and who make a qualifying purchase during the Giveaway and Promotion Period will be automatically entered to win.
3.1 Alternative Method of Entry. Neatly handprint your complete name and e-mail address on a plain 3” x 5” piece of paper, and mail it to: ThriftBooks Tote Bag Giveaway, 18300 Cascade Ave S #150, Tukwila, WA 98188.
Qualifying purchases do not include bulk and wholesale purchases, purchases made with benefits received under the ReadingRewards Program, sales tax, promotional credits, or shipping costs. Any order that is cancelled or where ThriftBooks processes a return that results in the order failing to be a qualifying purchase will become ineligible for the promotion.
An otherwise qualifying purchase of orders that are cancelled, returned, or refunded for any reason will not qualify for entry into the Giveaway and Promotion. All entries must be received or postmarked within the Giveaway and Promotion Period. No mechanically reproduced entries will be accepted. ThriftBooks assumes no liability for lost, late, incomplete, or misdirected entries. If any person uses fraudulent methods or otherwise attempts to circumvent the Official Rules, the entries may be disqualified at the sole discretion of ThriftBooks. By entering the Giveaway and Promotion, your email address will be used to communicate with you related to the Giveaway and Promotion and will be added to ThriftBooks’ customer email program; however, you can opt out by clicking the opt-out link in any email.
4. READINGREWARDS BONUS POINTS. By making a qualifying purchase during the Giveaway and Promotion Period, your ReadingRewards account will be credited with 75 bonus points. Your ReadingRewards account will not be credited with bonus points if you check out as a guest, even if your purchase is a qualifying purchase. This promotion is subject to standard ReadingRewards Terms & Conditions. There is no limit on the number of qualifying purchases and corresponding bonus points that can be earned during the Giveaway and Promotion Period. The bonus points will be applied to your ReadingRewards account after your qualifying purchase is placed and may take time (generally fewer than 24 hours) to be reflected in your account. If you are eligible for multiple ReadingRewards promos by making a purchase during the promotional period, only the one promo that results in the most bonus points being awarded to you will be applied to your order.
5. PRIZES. ThriftBooks will give away twenty (20) ThriftBooks tote bags during the Giveaway and Promotion Period (the “Prize(s)”). The Prizes have a value of approximately $14.52 each. Any cost or expense associated with the acceptance or use of the Prizes not specified herein as being awarded, including, but not limited to, federal, state, or local taxes, are the sole responsibility of the Winner. Prize details are at the sole discretion of ThriftBooks. No transfer, assignment, cash redemption, or substitution of the Prize is permitted, except by ThriftBooks who reserves the right to substitute the Prize with one of comparable or greater value.
6. ODDS OF WINNING A PRIZE. The odds of winning a Prize depend upon the total number of eligible entries received. The Prizes described herein will be awarded.
7. WINNER SELECTION. The “Winners” of the Prizes will be selected from eligible entries in a random drawing within ten days of the end of the Giveaway and Promotion Period. ThriftBooks reserves the right (but is not obligated) to verify eligibility qualifications of the potential Winners. The Winner will be required to provide their full name and may be required to sign an Affidavit of Eligibility and Liability/Publicity Release. By entering the Giveaway and Promotion, the entrant agrees to be bound by these Official Rules and to the decisions of ThriftBooks, which will be final and binding in all respects. ThriftBooks reserves the right, in its sole discretion, to void the entries of entrants in violation of these Official Rules or believed to have attempted to tamper with or impair the administration, security, fairness, or proper play of this Giveaway and Promotion.
8. WINNER NOTIFICATION. ThriftBooks will notify the Winner within ten days of the random selection. ThriftBooks will contact the Winner at the email address used by such Winner for the qualifying purchase that resulted in entry into the Giveaway and Promotion and/or at the address provided with the Winner’s alternative method of entry. The Winner will have seven days to claim their Prize by responding to ThriftBooks’ notification. The potential Winner’s failure to respond by claiming their Prize within seven days of notification, or return of the notification email as non-deliverable, may result in disqualification of the Winner and—at the discretion of ThriftBooks—awarding of the Prize to an alternate Winner.
9. RIGHTS GRANTED BY WINNER. ThriftBooks may use the Winner’s name and likeness in any medium without permission or further compensation, except as prohibited by law. The identity of the Winner may be obtained by sending a self-addressed and stamped envelope within one year of the Giveaway and Promotion Period to: ThriftBooks Tote Bag Giveaway Winner’s List, 18300 Cascade Ave S #150, Tukwila, WA 98188.
10. ENTRY TERMS AND THRIFTBOOKS’ USE. By entering, entrants agree: (1) that ThriftBooks may contact the Winner via email and may use the Winner’s name and likeness; (2) ThriftBooks may store any entrant’s information and may contact entrants in the future regarding ThriftBooks’ promotions or offers; (3) that entrant will not create multiple accounts or otherwise send multiple entries in order to enter the Giveaway and Promotion more than allowed by these Official Rules; (4) that entrant will not update, post, or link messages in violation of any third party website terms of use or otherwise violate the rights of any third party; (5) that ThriftBooks, and any social media platform, and each respective entity’s affiliates, subsidiaries, advertising and promotion agencies, partners, and each of their respective representatives, agents, successors, assigns, employees, officers, directors, agents, and representatives (collectively the “Indemnified Parties”), shall have no liability and will each be held harmless by entrant or any party claiming through entrant for any claim, action, liability, loss, injury, or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, arising in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, misuse or non-use of the Prize, or the participation or non-participation in the Giveaway and Promotion; (6) that ENTRANTS WAIVE ALL RIGHTS TO CLAIM FROM THE INDEMNIFIED PARTIES ANY DAMAGES, INCLUDING WITHOUT LIMITATION, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, AND ATTORNEYS’ FEES; (7) to be bound by these Official Rules and the decisions of ThriftBooks, which are final and binding on all matters relating to the Giveaway and Promotion; (8) to waive any right to claim any ambiguity or error in these Official Rules or the Giveaway and Promotion itself; (9) that ThriftBooks is not responsible for taxes associated with winning a Prize in this giveaway; (10) that Winner may be required to provide certain tax related documents to ThriftBooks as required by law before receiving the Prize; (11) that all participants must abide by the terms of use of any social media platform, all third party agreements that may affect or be affected by participation in this Giveaway and Promotion, and all applicable law; and (12) that all information submitted to ThriftBooks is subject to the ThriftBooks Privacy Policy available through the following link: https://www.thriftbooks.com/privacypolicy.aspx
11. RIGHT TO CANCEL GIVEAWAY AND PROMOTION. If for any reason this Giveaway and Promotion is not capable of being run or implemented as planned (as determined by ThriftBooks in its sole discretion), due to any reason including, but not limited to, tampering, unauthorized intervention, fraud, computer viruses or bugs, or any other cause of any kind, which, in ThriftBooks’ sole judgment, is likely to or actually corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of the Giveaway and Promotion (including, but not limited to, tampering, unauthorized intervention, fraud, or any other cause of any kind), then ThriftBooks reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend all or any part of the Giveaway and Promotion or to disqualify any implicated entrant and any associated entries. In the event of cancellation or termination, ThriftBooks reserves the right, in its sole discretion, to pick the winner in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or termination.
Any attempt to deliberately damage any website or undermine the legitimate operation of this Giveaway and Promotion is a violation of criminal and civil laws and should such an attempt be made, ThriftBooks reserves the right to seek damages (including attorneys’ fees) and other remedies from any such person responsible for the attempt to the fullest extent permitted by law. ThriftBooks reserves the right, in its sole discretion, to disqualify any entrants whom ThriftBooks believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Giveaway and Promotion or is in violation of these Official Rules, and void all associated entries.
12. DISCLAIMER. ThriftBooks is not responsible for late, lost, stolen, damaged, illegible, incomplete, misdirected, delayed, garbled, inaccurate, postage due or undelivered mail, or for telephonic, human, or computer failures, interruptions in service due to system upgrades, repairs, modifications, or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Giveaway and Promotion, including, without limitation, errors which may occur in connection with the administration of the Giveaway and Promotion, the processing of entries or electronic mail or the announcement, delivery or use of the Prize, or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Giveaway and Promotion, or for printing, typographical, computer, network, electronic, mechanical, human or other errors appearing in these Official Rules or other Giveaway and Promotion-related materials.
13. UNFORESEEN CIRCUMSTANCES. The failure of ThriftBooks to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, pandemic, earthquake, terrorism, act of public enemies, action of governmental authorities, or any force majeure event or event outside the control of ThriftBooks, whether in whole or in part, will not be considered a breach of these Official Rules.
14. SEVERABILITY; WAIVER. These Official Rules will be enforced to the fullest extent permitted by applicable law. If for any reason any provision of these Official Rules is held to be invalid or unenforceable to any extent, then (A) the provision will be interpreted or reformed to the extent reasonably required to render the provision enforceable and consistent with the original intent underlying the provision; (B) the provision will remain in effect to the extent that it is not unenforceable; and (C) the unenforceability of the provision will not affect any other portion of these Official Rules. The failure by ThriftBooks to enforce any of the provisions of these Official Rules will in no way be construed as a waiver of any provision of these Official Rules in any instance.
15. GOVERNING LAW; JURISDICTION; CLASS ACTION WAIVER: This Giveaway and Promotion is governed by the laws of the State of Washington, USA, without reference to conflicts of laws principles. As a condition of participating in this Giveaway and Promotion, PARTICIPANT AGREES THAT ANY AND ALL DISPUTES ARISING OUT OF OR RELATED TO THIS GIVEAWAY AND PROMOTION WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, EXCLUSIVELY BEFORE THE STATE OR FEDERAL COURTS IN SEATTLE, WASHINGTON.
